To date, more than 1,000 discrete pieces of COVID-19 litigation, including more than 125 class-action lawsuits, have been filed in U.S. courts.  As companies continue to make critical and difficult decisions about workforce management, insolvency and restructuring, contractual commitments, public disclosures, and employees' return to the workplace, they face the risk of numerous different types of litigation. While insurance may potentially assist with the costs of certain types of such litigation, it poses its own complexities and possible issues.

Please join Dan Small '79 and litigation partner at Holland & Knight, and Machua Millett '00 and Managing Director at insurance broker Marsh USA, Inc., for a discussion of:

  • The prominent types of litigation filed to date, including consumer class actions, federal securities, broken-deal, anti-competitive and price-gouging, safety/negligence, employment, and privacy matters

  • Common themes, arguments, considerations, and potential defenses in this litigation

  • Insurance coverage that may exist for such cases, as well as potential insurance issues that may arise and strategies to maximize recovery

Dan Small '79 is a litigation partner in the Boston and Miami offices of Holland & Knight. A former federal prosecutor and former corporate General Counsel, Dan focuses his practice on internal and external investigations, white collar criminal matters, complex civil litigation, and witness preparation. He is the author of several books for the ABA on litigation, including “Preparing Witnesses (4th Ed., 2014), was a Lecturer on Law at HLS, and is a frequent CLE speaker and media commentator.

Machua Millett '00 is a Managing Director at global insurance broker Marsh, where he specializes in management and professional liability coverage and claims advocacy for public and private companies and alternative investment firms.  Mach is a former securities litigation defense and insurance coverage lawyer, is a frequent speaker and author on management and liability insurance issues, and is a Guest Lecturer on insurance law at HLS.
